83-3660 Vacate Dedication Union Cemetery Addition1 1 A RESOLUTION RECOMMENDING THE VACATION OF CERTAIN DEDICATION ON THE PLAT OF UNION CEMETERY ADDITION. WHEREAS, on or about June 16, 1983, the owners of Union Cemetery Addition to the City of Salina submitted a petition to the Saline County Clerk requesting that the Board of County Commissioners of Saline County vacate the dedication on a portion of said Union Cemetery Addition; WHEREAS, said petition for vacation appears to be based upon K.S.A. 12-504 and, whereas, said Statute requires recommendation from the Governing Body for vacation of dedications on properties located within the corporate limits of a municipality; WHEREAS, on February 22, 1982 and April 5, 1982, the Salina City Commission, meeting in formal session, and after considering evidence and hearing testimony on petitions similar to the June 16, 1983 petition, voted not to recommend approval of said petitions; WHEREAS, the question of removal of certain dedication on the plat of Union Cemetery Addition to the City of Salina has been over the recent past a cause of considerable public controversy and misstatement and misinformation as to fact and circumstance; WHEREAS, on September 12, 1983, after public notice, the City Commission held a public hearing on the petition dated June 16, 1983; WHEREAS, the Salina City Commission believes that granting the vacation requested in the petition dated June 16, 1983, is not in the public interest; WHEREAS, notwithstanding the City Commission's conviction that granting said petition is not in the public interest, the City Commission believes it is fitting and proper that the petitioner be given the opportunity to fully exercise all legal rights permitted under Kansas Statutes. NOW, THEREFORE, BE IT RESOLVED that the Salina City Commission recommends to the Board of County Commissioners of Saline County that the petition dated June 16, 1983, for the vacation of the dedication of a portion of platted land in the Union Cemetery Addition to the City of Salina be granted or denied at the discretion of the Board of County Commissioners of Saline County.
