82-3620 Execute Warranty Deed Federal Mogul Corp1 1 1 RESOLUTION NUMBER 82-3620 A RESOLUTION AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE A SPECIAL WARRANTY DEED IN FAVOR OF FEDERAL-MOGUL CORPORATION PURSUANT TO ORDINANCE NUMBER 8288. WHEREAS, pursuant to the provisions of Ordinance Number 8288, the City of Salina, Kansas, by Warranty Deed dated June 22, 1973, recorded in Deed Book 299, page 188, became the owner of the hereinafter described real estate; and, WHEREAS, the lease which was authorized by said ordinance provided that the tenant has the option to purchase the said real estate upon full payment of all outstanding bonds and payment of an additional sum of Twelve Thousand Five Hundred Dollars ($12,500); and, WHEREAS, Federal-Mogul Corporation, the present tenant, has now fully complied with all the providions of said Lease and Ordinance and has elected to exercise its option to purchase said real estate. NOW THEREFORE BE IT RESOLVED by the Governing Body of the City of Salina, Kansas: Section 1. That upon the receipt of the sum of Twelve Thousand Five Hundred Dollars ($12,500) the Mayor and City Clerk be and they are hereby authorized and directed to execute a Special Warranty Deed in favor of Federal- Mogul Corporation conveying unto it the following described real estate, to -wit: All of that part of the South Half of the Northwest Quarter (S/2 NW/4) of Section One (1), Township Fifteen South (15S), Range Three West (3W) of the Sixth P.M., described as the West Forty-three Feet (W.43') of Lot Four (4) and all of Lots Five (5), Six (6), Seven (7), Eight (8), Nine (9), Ten (10), Eleven (11), and Twelve (12), and the East Twenty-six Feet (E 26') of Lot Thirteen (13); and the East Ninety-two Feet (E 92') of Lot Twenty-six (26) and all of Lots Twenty-seven (27) and Twenty-eight (28) and the West Ninety-four Feet (W 94') of Lot Twenty-nine (29); all in Block Two (2), Industrial Area, in Saline County, Kansas, together with all improvements located thereon, subject however, to the restrictions and conditions as set forth in said Ordinance and Lease. Section 2. The Mayor and the City Clerk are hereby further authorized and directed to execute a Bill of Sale in favor of Federal-Mogul Corporation covering any interest the City may have in the fixtures, machinery, equipment and other personal property covered by the Lease Agreement authorized by Ordinance Number 8288.
