A RESOLUTION authorizing and ordering certain curbing, guttering, paving, grading, storm sewer, wa;termain, sanitary sewer and drainage improvements ordering preparation of plans and specifications, and the estimate of costs. WHEREAS, a petition was filed with the City Clerk on.the 16th day of November, 1981, proposing certain paving, grading, storm sewer, water main and sanitary sewer improvements in Country Hills Addition Number 2; and WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did on the 14th day of December, 1981, find such petition to be sufficient; and WHEREAS, a petition was filed with the City Clerk on the 20th day of January, 1982, proposing certain curbing, guttering, paving, grading, storm sewer, water main and sanitary sewer improvements in the Replat of Lakewood Addition; and WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did on the 1st day of February, 1982, find such petition to be sufficient; and WHEREAS, a petition was filed with the City Clerk on the 20th day of January, 1982,.proposing certain curbing, guttering, paving, grading, storm sewer, water main and sanitary sewer improvements in Twin Oaks II Subdivision; and WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did on the 1st day of February, 1982, find such petition to be sufficient; and WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did on the 22nd day of February, 1982, duly adopt a resolution finding it advisable to make the aforementioned improvements under the provisions of Chapter 12, Article 6a of the Kansas Statutes Annotated, SO NOW, THEREFORE BE IT RESOLVED by the Board of Commissioners of the City of Salina, Kansas: Section 1. That the following improvements are hereby authorized to be made in accordance with the findings of the Board of Commissioners: Country Hills Addition Number 2 Paving, grading, and drainage pipe in FAIRDALE ROAD from Fairdale Court to Etherington Court. Paving, grading, and drainage pipe in ETHERINGTON COURT from Fairdale Road to cul-de-sac. Water main to serve Lots Seventeen (.17) through Twenty-four (24), Block Two (2), and Lots Twenty-one (21) through Twenty-five (25), Block Three (3), Country Hills Addition Number 2. Lateral Sanitary Sewer 611 Lateral Sanitary Sewer 612 Replat of Blocks 3, 4; 5, 6, and 8, Lakewood Addition Curbing, guttering, paving and grading of CIRCLE -DRIVE from Ohio Street to Elm Street and the Circle Drive and Elm Street intersection and the storm sewer system to serve the above described street improvement.. Lateral Sanitary Sewer 613 Lateral Sanitary Sewer 614 1 n n Water system to serve Lots Two (2) through Five (5), Block One (1); and.Lots One (l) through Four (4), and part of Lot Twenty-two (22), Block Two (2), Replat of 3, 4, 5, 6, and 8, Lakewood Addition to the City of Salina, Saline County, Kansas. Twin Oaks II Subdivision Curbing, guttering, paving and grading of BURR OAK LANE from Ohio Street to a point 230.8 feet west of the west line of Redbud Lane. A drainage ditch over and upon the following described parcel of land in the South.Half of the Northwest Quarter of Section Thirty-one (31), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian beginning at a point on the east right-of-way line .of Ohio Street, and ninety-three feet (93') south of the northwest corner of the south half of the Northwest Quarter.of the above mentionec section, thence running east a distance of two thousand nine hundred eighty-two feet (2,982') and parallel to the north line of the south half of the above mentioned Northwest Quarter Section to the Smoky Hi11.River. Channel. A drainage ditch beginning at a point ninety-three feet (939 south and sixty-five feet (659 west of the northwest corner of the South Half of the Northwest Quarter of Section Thirty-one (31), Township Fourteen (14) South, Range Two (2) West of the Sixth Principal Meridian, thence running south along a line and sixty-five feet (65') west of the center line of Ohio Street to the south line of the Northwest Quarter of said Section where the ditch intercepts the existing west ditch of Ohio Street. There shall be a sixty (60) RCP with end sections installed where the drainage system crosses Ohio Street and where it crosses Burr Oake Lane. There shall be a storm sewer pipe installed in Burr Oak.Lane from.Ohio Street to the west line of Lot 9, Block 7, Twin Oaks II Subdivision. Lateral Sanitary Sewer 615 Six inch water main beginning by connecting to an existing six inch water main in the intersection of Burs Oak Lane and Ohio Street, thence running west in Burr Oak Lane to the intersection of Burr Oak Lane and Redbud Lane. Section 2. The extent or boundaries of the proposed improvement district to be assessed is: That part of the City of Salina, Saline County, Kansas, described as follows, to -wit: Part of Lot Sixteen (16), and all of Lots Seventeen (17) through Twenty-four (24), Block Two (2) and part of Lot Eighteen (18) and all of Lots Nineteen (19) through Twenty-five (25)., Block Three (3), Country Hills Addition Number 2 to the City of Salina, Saline County, Kansas. All of Block Seven (7), Lakewood. Addition to the City of Salina, Saline County, Kansas. All of Lots One (1) through Seven (7), Block One (1); all of Lots One (1) through Four (4), and all of Lots Six (6) and Seven (7), and the North half of Lot Twenty-two (22), Block Two (2), Replat of Blocks 3, 4, 5, 6, and 8, Lakewood Addition to the City of Salina, Saline County, Kansas. Lots One (1) through Five (5), Block One (1); Lots One (1) through Thirty-three (33), Block Two (2); Lots One (1) through Twenty-one (21), Block Three (3); Lots One (1) through Thirteen (13), Block Four (4); Lots One (1) through Eight (8), Block Five (5); Lot One (1), Block Six (6); Lots One (1) through Twelve (12), Block Seven (7); Lots One (1) through Twelve (12), Block Eight (8), all in Twin Oaks II Subdivision to the City of Salina, Saline County, Kansas. LJ F1 Section 3. The estimated or probable cost of such improvement is $621,191.75. Section 4. The apportionment of cost between the improvement district and the City -at -large is as follows: I. Costs chargeable to private property in the amount of $618,431.75. 2. Costs chargeable to the City -at -large in the amount of $2,760.00. Section 5. The assessment with accrued interest shall be levied as a special tax upon the property included within the benefit district concurrent with the general property taxes and shall be payable in ten (10) equal annual installments. Section 6. The method of assessment shall be based on the adjusted front footage of each lot of land and without regard to the buildings or improvement of the land. Section 7. The City Engineer be and is hereby directed and ordered to prepare plans and specifications, and estimates of the cost of said improvements. Section 8. That for the purpose of providing funds to pay the cost of such improvements until bonds can be issued therefor, the Mayor and City Clerk be and they are hereby authorized to execute temporary notes of the City of Salina,Kansas, as provided by K.S.A. 10-123 and 12-6a04, not to exceed the aggregate provided by law. Such temporary notes may be issued by Resolution from time to time as required during the progress of the work on the improvements herein recited. Such temporary notes shall be in the form and executed as provided by law. Section 9. The City Clerk is hereby authorized and directed to make progress payments to the contractors for materials furnished and labor performed under the contract when estimates therefor are presented to him which have been properly certified by the City Engineer, so long as the aggregate payments do not exceed the total contract price.
