81-3570 Install Improvements in Undevelopment Area Policy1 1 1 RESOLUTION NUMBER 81-3570 .A RESOLUTION DETERMINING THE POLICY OF THE BOARD OF COMMISSIONERS OF THE CITY OF SALINA, KANSAS, IN REGARDS TO THE INSTALLATION OF IMPROVEMENTS IN UNDEVELOPED AREAS WITHIN. THE CITY. WHEREAS, it is the desire of the Board of Commissioners of the City of Salina, Kansas, to encourage growth within the City of Salina, Kansas, in the development of both residential and commercial land within the City limits; and, WHEREAS, the Board of Commissioners of the City of Salina, Kansas, intends to protect the taxpayers of this City from being required to pay for unpaid special assessments which may be levied as the result of such improvements SO NOW, THEREFORE, Kansas: BE IT RESOLVED by the Board of Commissioners of the City of Salina, Section 1. That it is hereby declared to be the policy of the Board of Commissioners of the City of Salina, Kansas, to encourage the development of undeveloped residential and commercial land within the City if the same can be done without placing a burden on the taxpayers. Section 2. That in order to promote the development of undeveloped commercial and residential land within the City limits. the following policy will generally be followed when a petition for improvements toï¿œundeveloped commercial and residential property is filed. Consideration of the following items will be considered prior to the approval or denial of a petition for special improvements (a) Need forthe type of land to be.improved. Petitioner will be required to submit evidence satisfactory to the Board Of Commissioners.to indicate a need within the City for the type of property which the petitioner seeks to develop. Consideration will be given to the amount of similar property located within the City limits which is available for development. (b) Financial consideration. In an attempt to protect the taxpayers of the City from assuming the burden of unpaid special assessments which may be levied for the improvements, consideration will be given to the financial responsibility of the petitioners and their ability to pay the special assessments as they become due. In this regards petitioners will be required to submit satisfactory evidence to show that at the time of the filing of the petition that the petitioners are not delinquent in the payment of general property taxes or special assessments on any property they own in the City of Salina. (If the petitioner is a corporation, then the same showing must be made as to all stockholders). (c) Drainage. Petitioner shall submit satisfactory evidence showing that the property can be developed in accordance with the present building codes and that the development of the same will not cause drainage problems for adjoining properties. (d) Petitioners. Petition must be signed by at least fifty percent 500 of the owners of the land area within the benefit district and by at least fifty percent (50%) of the resident owners of the land within the benefit district. (e) Other information. Petitioner shall submit other information and data as may be requested by the City Manager which may be necessary to make a determination of the feasibility of the improvements. Section 3.
