RESOLUTION NUMBER 81-3557

ME
A RESOLUTION authorizing and ordering certain curbing, guttering,
paving, grading, storm inlets, sewer piping improvements, ordering preparation
of plans and specifications, and the estimate of costs.
WHEREAS, a petition was filed with the City Clerk on the 23rd day of
July, 1981, proposing certain curbing, guttering, paving, grading, storm inlets,
sewer piping improvements in Interstate District North of 1-70 Addition, and
Interstate District North of 1-70 Addition Number 2; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did
on the 3rd day of August, 1981, find such petition to be sufficient; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas, did
on the 10th day of August, 1981, duly adopt a resolution finding it advisable to
make the aforementioned improvements under the provisions of Chapter 12, Article
6a of the Kansas Statutes Annotated, SO NOW, THEREFORE
BE IT RESOLVED by the Board of Commissioners of the City of Salina,
Kansas:
Section 1. That the following improvements are hereby authorized to
be made in accordance with the findings of the Board of Commissioners:
Curbing, guttering, paving, grading, storm inlets, sewer piping and
any incidental work to complete the street improvement on DIAMOND
DRIVE from the west end of the existing pavement, approximately four
hundred feet (400') west of the center line of U.S. 81 Highway (Ninth
St;r-eet) to a point nine hundred seventy-one feet (9719 west.
Section 2. The extent or boundaries of the proposed improvement
district to be assessed is:
That part of the City of Salina, Saline County, Kansas, described as
follows, to -wit:
Lots 3, 4, 5, 6, and the East one hundred twenty-three and three
tenths feet (123.3') of Lot 7, Interstate District North of 1-70
Addition.
The West twenty-one and thirty-two hundredths feet (21.32') of Lot 2,
the South one hundred sixty-eight and five tenths feet (168.5') of Lot
5 and all of Lot 6, Block 1, Interstate District North of 1-70 Number
2 Addition.
The East four hundred thirty-three and five tenths feet (433.5') of
the South six hundred three and two tenths feet (603.2') of Lot 1,
Block 2, Interstate District North of 1-70 Number 2 Addition

The West thirty-four and forty-three hundredths feet (34.431) d'the
NE/4 of Section Thirty-five (35), Township Thirteen (13) South, Range
Three (3) West of the Sixth Principal Meridian in Saline County,
Kansas, described as follows:
Beginning at a point on the west right-of-way of US Highway 81,
said point being one hundred eleven and eight tenths feet (111.8')
north and sixty-five and seven tenths feet (65.7') west of the
southeast corner of the Northeast Quarter (NE/4) of said Section
Thirty-five (35);
Thence north along the west right-of-way line of US 81 a distance
of four hundred seventy-seven and three tenths feet (477.3') to a
point;

Thence south forty-six degrees five minutes west .(S.4605'00"w.) a
distance of five hundred forty-one and eight tenths feet (541.8')
to a point on the northerly right-of-way line of a county road
(now Diamond Drive in the City of Salina), said right-of-way line
being an arc of a circle whose radius is four hundred fifty-six
and seventy-five hundredths feet (456.75');
Thence in an easterly direction along said right-of-way line a
distance of four hundred seventeen and eighty-seven hundredths
feet (417.87') to the point of beginning;
Excluding therefrom, however, the land and rights conveyed
therefrom unto the State Highway Commission of Kansas, and/or
the State of Kansas as of record; all in the City of Salina,
Saline County, Kansas.
Section 3. The estimated or probable cost of such improvement is
$129,616.20.
Section 4. The apportionment of cost between the improvement district
and the City -at -large is as follows:
Costs chargeable to private property in the amount of $129,616.20.
2. No costs chargeable to the City -at -large.
Section 5. The assessment with accrued interest shall be levied as a
special tax upon the property included within the benefit district concurrent
with the general property taxes and shall be payable in ten (10) equal annual
installments.
Section 6. The method of assessment shall be based on the adjusted
front footage of each lot of land and without regard to buildings or improvements
of the land.
Section 7. The City Engineer be and is hereby directed and ordered to
prepare plans and specifications, and estimates of the cost of said improvements.
Section 8. That for the purpose of providing funds to pay the cost of
such improvements until bonds can be issued therefor, the Mayor and City Clerk
be and they are hereby authorized to execute temporary notes of the City of
Salina, Kansas, as provided by K.S.A. 10-123 and 12-6a04, not to exceed the
aggregate provided by law. Such temporary notes may be issued by Resolution
from time to time as required during the progress of the work on the improvements
herein recited. Such temporary notes shall be in the form and executed as
provided by law.
Section 9. The City Clerk is hereby authorized and directed to make
progress payments to the contractors for materials furnished and labor performed
under the contract when estimates therefor are presented to him which have been
properly certified by the City Engineer, so long as the aggregate payments do
not exceed the total contract price.
Adopted by the Board of Commissioners and signed by the Mayor this
17th day of August, 1981.
