RESOLUTION NUMBER 89-4111
A RESOLUTION AUTHORIZING AND ORDERING CERTAIN CURBING,
GUTTERING, PAVING, GRADING, STORM DRAINAGE, WATER MAIN AND
SERVICES, AND SANITARY SEWER IMPROVEMENTS, ORDERING PREPARATION
OF PLANS AND SPECIFICATIONS, AND THE ESTIMATE OF COSTS,
WHEREAS, a petition was filed with the City Clerk on the 6th day of
December, 1988, proposing certain sanitary sewer improvements in Waters
Subdivision; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 9th day of January, 1989 find such petition to be sufficient; and
WHEREAS, a petition was filed with the City Clerk on the 27th day of
March, 1989, proposing certain sanitary sewer improvements in Meyer Addition;
and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 3rd day of April, 1989 find such petition to be sufficient; and
WHEREAS, a petition was filed with the City Clerk on the 9th day of
May, 1989, proposing certain curbing, guttering, paving, grading, storm sewer,
water main and service improvements in Meyer Addition; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 15th day of May, 1989 find such petition to be sufficient; and
WHEREAS, a petition was filed with the City Clerk on the 22nd day of
May, 1989, proposing certain curbing, guttering,, paving, grading, storm sewer,
water main and service and sanitary sewer improvements in Meyer Addition, and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 5th day of June, 1989 find such petition to be sufficient; and
WHEREAS, a petition was filed with the City Clerk on the 14th day of
June, 1989, proposing certain curbing, guttering, paving, grading, storm
sewer, water main and service and sanitary sewer improvements in Mariposa
Addition; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 19th day of June, 1989 find such petition to be sufficient; and
WHEREAS, a petition was filed with the City Clerk on the 28th day of
June, 1989, proposing certain curbing, guttering, paving, grading, storm
drainage, water main and services and sanitary sewer improvements in Country
Oak Addition; and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 10th day of July, 1989 find such petition to be sufficient; and
WHEREAS, a petition was filed with the City Clerk on the 30th day of
June, 1989, proposing certain curbing, guttering, paving, grading, storm
sewer, water main and service and sanitary sewer improvements in Country Club
Estates Addition Number 4, and
WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 10th day of July, 1989 find such petition to be sufficient; and

WHEREAS, the Board of Commissioners of the City of Salina, Kansas,
did on the 7th day of August, 1989, duly adopt a resolution finding it advisable
to make the aforementioned improvements under the provisions of Chapter 12,
Article 6a of the Kansas Statutes Annotated, SO NOW, THEREFORE
BE IT RESOLVED by the Governing Body of the City of Salina,
Kansas:
Section 1. That the following improvements are hereby authorized to
be made in accordance with the findings of the Board of Commissioners.
Waters Subdivision
Relocation of existing sanitary sewer facilities which
currently runs through the north portion of Lot 1, Block 1
Waters Addition. The new facilities would be located along
the west side of Lots 1 and 2, Block 1 , Waters Addition, and
along the north side of said Lot 2.
Meyer Addition
Lateral Sanitary Sewer 656.
Curbing, guttering, paving, grading of FREDRICH DRIVE
from Manchester Road east to a cul-de-sac adjacent to Lots
14 and 15, Block 5, and Lots 22 and 23, Block 6, Meyer
Addition.
The installation of a storm sewer system to provide drainage
for the above described street improvements on Fredrich
Drive.
The installation of 1" water service lines for Lots 14 through
21, Block 5, and Lots 16 through 23, Block 6, Meyer
Addition, by connecting to a proposed 6" C.I.P, water main
to be installed in Fredrich Drive.
Curbing, guttering, paving, grading of REPUBLIC AVENUE
from Manchester Road east to the east boundary of Meyer
Addition.
The installation of a storm sewer system to provide drainage
for the above described street improvement on Republic
Avenue.
The installation of 1" water service lines for Lots 1 through
12, Block 6; Lots 2 through 8, Block 7; Lots 1 through 4,
Block 8, all in Meyer Addition, by connecting to a proposed
6" C.I.P. water main to be installed in Republic Avenue.

Section 3. The estimated or probable cost of such improvements is
$1,525,504.50.
Section 4. The apportionment of cost between the improvement district
and the City -at -large is as follows:
1. Costs chargeable to private property in the amount of
$1,469;444.50.
2. Costs chargeable to the City -at -large in the amount of $56,060.00.
Section 5. The assessment with accrued interest shall be levied as a
special tax upon the property included within the benefit district concurrent
with the general property taxes and shall be payable in ten (10) equal annual
installments.
Section 6. The method of assessment shall be based on the adjusted
front footage, adjusted square footage, or lump sum for each lot of land and
without regard to the buildings or improvements of the land.
Section 7. That the City Engineer be and is hereby directed and
ordered to prepare plans and specifications and estimates of the cost of said
improvements.
Section 8. That for the purpose of providing funds to pay the cost of.
such improvements until bonds can be issued therefor, the Mayor and City Clerk
be and they are hereby authorized to execute temporary notes for the City of
Salina, Kansas, as provided by K.S.A. 10-123 and 12-6a04, not to exceed the
aggregate provided by law. Such temporary notes may be issued by Resolution
from time to time as required during the progress of the work on the
improvements herein recited. Such temporary notes shall be in the form and
executed as provided by law.
Section 9. That the City

make progress payments to the contractors
for materials furnished
and labor
performed under the contract when
estimates
therefor are presented
which have
been property certified by the City
Engineer,
so long as the aggregate payments
do not exceed the total contract price.

prepare plans and sjecificatians and

Section 8. That, for the purpose of

improvements until bonds can be is-
sued therefor, the , Mayor and City
Clerk be and they are hereby author-
ized to execute temporary nol''es for the
City of Salina, Kansas, as provided by
K.S.A. 10-123 and 12-6a04, not to ex-
ceed the aggregate provided by law.

Resolution from time to time. as re-
quired during the progress of the work
on the improvements herein recited.
(Such temporary notes, shall be in the
form and executed as provided by law.
Section 9. That the City Clerk is
hereby authorized ;.and directed. to
Imake progresspayments to the con-
tractors for materials furnished. and'
labor performed under the contract
,when estimates therefor are presented
which have been properly certified by
the City Engineer, so long as the
aggregate payments do not exceed the
total contract price.
Adopted by the Board of Commis-
sioners and signed by the Mayor this
