RESOLUTION NUMBER 89-4103
A RESOLUTION AUTHORIZING APPLICATION FOR A DRINKING
ESTABLISHMENT LICENSE FOR THE BICENTENNIAL CENTER.
WHEREAS, the City of Salina owns and operates the Bicentennial
Center, a multi-purpose facility used primarily as a sports arena, exhibition
hall, and convention center; and
WHEREAS, it is the desire of the Governing Body to provide for the
responsible management of the serving of cereal malt beverage and alcoholic
liquor at appropriate events held at the Bicentennial Center; and
WHEREAS, the Kansas Attorney General has opined that the City of
Salina, as a municipal corporation is not specifically precluded from obtaining a
license to operate a drinking establishment as long as it is otherwise qualified
and meets relevant requirements and that the City may only hold such license to
further a public purpose, such as operating the concession at the Bicentennial
Center; SO NOW, THEREFORE
Kansas:
BE IT RESOLVED by the Governing Body of the City of Salina,
Section 1. That Staff is hereby authorized and directed to apply for
and obtain a Kansas drinking establishment license for the exclusive purpose of
operating the concession at the Bicentennial Center.
Section 2. The City Manager or his designee is hereby designed as
the authorized agent for the City of Salina, a Kansas municipal corporation, for
the purpose of applying for and obtaining the drinking establishment license
f authorized in Section 1 above.
