Farm Lease Agreement FARM LEASE AGREEMENT This Lease Agreement, made and entered into this J.,(jJ'f1: day of March 2007, by and between THE CITY OF SALINA, KANSAS, a municipal corporation, hereinafter referred to as the "City", and ;','Garv& 'David'O'l'so~ hereinafter referred to as the "Lessee", WITNESSETH: The City hereby leases to the Lessee, to occupy and use for agricultural and related purposes, the following described property Land Located South of Salina Soccer Comolex. 2100 E Maanolia. , Shown as Attachment "A: consisting of approximately ...llL acres situated in Saline County. Kansas (State) with all improvements thereon. 1. Use of Premises: Lessee agrees to use the Premises for agricultural purposes only as hereinafter specified: Cultivated Land, Lessee agrees to farm the cultivated land in due season and in a prudent and workmanlike manner and not to allow waste upon the Premises by virtue of failure to properly protect the cultivated land from wind or water erosion. 2, Compensation: The Lessee shall pay to the City for the right to farm the premises identified the sum of $40.00 per year, per acre, payable in equal installments of one half on April 1 , 2007 and the second half payment on October 1 sl of each year during which this Agreement remains in effect 3. Access to Property: The City agrees to provide access by the Lessee to the 10 acre tract either through the City owned Salina Soccer Complex drive and parking areas or across the City owned flood control levy. Approval of the selected access route by the City of Salina will be required prior to accessing the property. 4. General Terms of Lease: Time period covered. The provisions of this agreement shall be in effect for (1) ONE year, commencing on the April 1st day of 2007. This lease shall self renew annually unless written notice of termination is given by either party to the other at least (60) sixty days prior to expiration of this lease or the end of any year of continuation. 5. If termination is given by the City (60) sixty days prior to termination date. the Lessee shall have the right to harvest any crop currently planted at time the termination notice was given. 6. Amendments and alterations: Amendments and alterations to this lease shall be in writing and shall be signed by both the City and Lessee. 7. No partnership intended: It is particularly understood and agreed that this lease shall not be deemed to be, nor intended to give rise to, a partnership relation. 8. Right of entry: The City, as well as agents and employees of the Lessee, reserve the right to enter the farm at any reasonable time to: a) consult with Lessee; b) make repairs, improvements, and inspections; and c) (after notice of termination of the lease is give) do tillage, seeding, fertilizing, and any other customary seasonal work, none of which is to interfere with the tenant in carrying out regular farm operations. 9. Indemnification: The Lessee agrees to indemnify and hold the City harmless for any claim, damages, loss, judgment, penalty, expense, or cost (including attorney's fees and any other cost of defense) arising out of their farming operation under this Agreement. 10. Public Liability Insurance: The Lessee agrees to carry public liability insurance coverage in an amount no less than the maximum exposure to the City under the Kansas Tort Claims Act, as it is now in effect or as it may be amended during the term of this Agreement (currently $500, 000). The Lessee shall provide the City with written proof of current coverage from the insurance company. The policy shall contain a provision requiring that the City be given at least (10) days written notice by the insurance company before the policy is substantially changed or canceled. 11. Binding Effect: This Lease Agreement shall be binding upon the heirs, executors, administrators, successors and assigns of the respective parties to this Lease Agreement. 12. No right to sublease. The City does not convey to the Lessee the right to lease or sublet any part of the farm or to assign the lease to any person or persons whomsoever. 13. The Lessee agrees: To use diligence to prevent noxious weeds from going to seed on the farm.
