The final certifications of cost s have been filed by the City E ngineer for the following public

The public hearing is intended to receive input fr om interested parties and particularly property
owners within the special assessment benefit district. The primary issue at this point in the process is
not whether the special assessments should be levied against the properties, but rather that the final
costs have been properly calculated and distributed. A summary of key dates in the process are as

FISCAL NOTE:
This action sets the foundation for the final determination of assessments after the public hearing.
The assessments so determined will play a significant role in retirement of the associated debt over
the next 15 years.

available resources and staff commitment to quality.
RECOMMENDED ACTION:
Approve on first reading Ordinance No. 07-10383 levying special a ssessments for street,
drainage, and utility improvements for the 2007 Special Assessment Projects.
Set April 16, 2007 as the Special Assessment hearing date and instruct the City Clerk to publish a
Notice of Public Hearing and mail a notice to each property owner in the benefit district.

The Board of Commissioners of the City of Salina, Kansas, will meet in the City
Commission Meeting Room, Room 107, City-Count y Building, 300 West Ash Street, Salina,

proposed assessments for the public improvements listed below.
Written or oral objections will be considered at the meeting and thereupon the amount of

WATER MAIN IMPROVEMENTS
The improvements are generally described as:
The installation of approximately 3000 lin eal feet of 12” water main, fire
hydrants, valves, fittings, and necessary incidentals.
The above improvements were authori zed by Resolution No. 06-6280, passed by the
Board of Commissioners on June 5, 2006, as amended by Resolution No. 06-6283, passed by the
Board of Commissioners on June 19, 2006.
The total cost of such improvement is $201,950.72, and $84,688.60 is proposed to be
assessed to the properties within the improvement district.
The extent of boundaries of the improvement district to be assessed are described as
follows:

The improvements are generally described as:
Curbing, guttering, paving, grading and drainage for approximately 300 lineal feet
of Caywood Drive; approximately 737 linea l feet of Joanie Lane; approximately
562 lineal feet of Linda Lane; and approximately 135 lineal feet of Rittgers Lane.
Installation of approximate ly 216 square yards of six-inch concrete drainage
ribbon.
Installation of approximately 434 linea l feet eight-inch water main, fire
hydrants, valves, fittings, service connections for water lines lying within right-of-
way and all appurtenances thereto (the “Water System Improvements”.
Installation of approximately 727 lineal feet of sanitary sewer main, service
connections for sewer lines lying w ithin right-of-way, manholes and all
appurtenances thereto.
Installation of approximate ly 86 lineal feet of sanitary sewer main, service
connections for sewer lines lying within right-of-way, and all appurtenances
thereto.
The above improvements were authori zed by Resolution No. 06-6264, passed by the

The total cost of such improvement is $513,252.16, and $513,252.16 is proposed to be
assessed to the properties within the improvement district.

WHEREAS,
the total costs of such improvements ha ve been determined; the Governing Body
has caused the assessments against each lot, piece or parcel of land deemed to be benefited by such
improvements, to be determined in the manner set forth in the resolutions as to advisability of the
improvements provided for pursuant to K.S.A. 2-6a04; and an assessment roll has been prepared; and
WHEREAS,
such assessment roll was filed with the C ity Clerk and has been open to public
inspection; and
WHEREAS,
the City Clerk, at the direction of the Governing Body, caused notice of the
hearing on the special assessments to be published not l ess than 10 days prior to such hearing, and notice to

Section 2.
That the owner of Unplatted Tracts 1 and 2 in Project No. 04-1488 has requested a
deferral of the special assessments levied on said trac t hereunder; said tract qualifies under K.S.A. 12-6,110
et seq. for a deferral of special assessments; and the City hereby grants a deferral of the special assessments
levied hereunder on said tract for a period of 15 years or until such property is platted or developed,
whichever occurs first.
Section 3.
The special assessments provided for in Section 1 of this Ordinance shall be certified by
the City Clerk to the County Clerk in the same manner and at the same time as other taxes are certified. The
assessments and will be collected in fifteen (15) equal annual installments, together with interest on such
amounts at a rate not exceeding the maximum rate theref ore as prescribed by the Act. The first installment
shall become due with the first payment of general pr operty taxes for the year 2007. Interest on the assessed
amount remaining unpaid between the effective date of th is Ordinance and the date the first installment is
payable, but not less than the amount of interest due during the coming year on any outstanding bonds issued
to finance the Improvements, shall be added to the firs t installment. The interest for one year on all unpaid
installments shall be added to each subsequent installment until paid.
Section 4.
The owner of any piece or parcel of property liable for any such assessments may redeem
his property, in whole or in part, from such liability by paying to the City Treasurer the entire amount, or a
portion thereof, chargeable againstsaid property, at any time within thirty days after the first publication of
this ordinance, and to the extent of any such paymen t, the property so paid on shall not thereafter be liable
for any further assessments for the cost of said improvements, nor for any interest due thereon.
Section 5.
This Ordinance shall take effect from and after its passage and publication in the official
City newspaper.
